This Terms of Service Agreement (the "Agreement") governs the use of the Skills Based Hiring Platform (the "Platform") provided by Skills Project (the "Company"). This Agreement constitutes a binding agreement between the Company and any person or entity that uses the Platform (the "User").
The Platform is a skills-based hiring platform that connects candidates and companies. The Platform allows companies to post job listings, and candidates to create profiles and apply for jobs. The Company does not guarantee that a User will be able to find a job or candidate through the use of the Platform.
The User is responsible for maintaining the accuracy and completeness of its profile and job listings. The User agrees not to post any illegal, fraudulent, or inaccurate information on the Platform. The User also agrees not to use the Platform for any illegal or unethical purposes.
The User retains ownership of all content posted on the Platform, including but not limited to profiles, job listings, and messages. The User grants the Company a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, and distribute such content for the purposes of providing the Platform and promoting the Platform.
The User acknowledges that it may receive confidential information from the Company or other Users through the use of the Platform. The User agrees to keep such information confidential and not to use it for any unauthorized purposes.
The Platform is provided on an "as is" and "as available" basis. The Company makes no warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Platform will be uninterrupted or error-free, and the Company will not be liable for any interruptions or errors.
The Company will not be liable for any indirect, incidental, special, or consequential damages arising out of the use of the Platform. The total liability of the Company for any damages arising out of the use of the Platform will not exceed the amounts paid by the User to the Company for the use of the Platform.
Either party may terminate this Agreement at any time with or without cause. Upon termination, the User's right to use the Platform will immediately cease, and the User will remove all content from the Platform.
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this Agreement. This Agreement may only be amended in writing signed by both parties. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns.
By using the Platform, the User agrees to be bound by the terms and conditions of this Agreement. If the User does not agree to the terms of this Agreement, the User should not use the Platform.
